There’s more to the NSA domestic spying case than the current storyline — that much is clear. The idea that the Bush Administration needed to bypass the courts to get wiretaps quickly makes no sense; under the current system, you can start eavesdropping, and get a warrant later. The notion that disclosing the surveillance would somehow tip off potential terrorists is laughable, too; Al Qaeda types know they’re being monitored.
That’s all assuming, of course, that the wiretaps in this case are the same as in any other. But maybe they’re not. Maybe there’s something different about this surveillance. It could be in its scope, as Laura suggests. But I’m guessing — and this is just a guess — that the real difference is in the technology of the wiretaps themselves.
Look at what former senator Bob Graham (D-Fla.), who was briefed on the eavesdropping program, told the Washington Post:
“I came out of the room with the full sense that we were dealing with a change in technology but not policy,” Graham said, with new opportunities to intercept overseas calls that passed through U.S. switches.
Or what New York Times editor Bill Keller had to say about the paper’s year-long delay in breaking the story:
In the course of subsequent reporting we satisfied ourselves that we could write about this program — withholding a number of technical details — in a way that would not expose any intelligence-gathering methods or capabilities that are not already on the public record.
So maybe the NSA wiretaps were using a new kind of capability; one that terror suspects might not have know about; one that might have even made the FISA court uncomfortable, somehow.
It’s a lot of mights and maybes, I know. But the current threads of this story are so thin, it’s time to start considering some alternatives.

Echelon is reportedly able to intercept, record, and translate any electronic communication — telephone, data, cellular, fax, email, telex — sent anywhere in the world.

Perhaps it’s not new clean tech but dirty old tricks they are worried about. What could be learned from tapping a certain opponent, lawyer, prosecutor? Just ask Nixon. The tapping itself while illegal may pale in comparison to the outrage when and if we find out just who was being tapped.
Well, this isn’t about the law. It’s about executive privilege. Bush can spy on members of his own administration and on the opposition, as well as Americans, with impunity. As John Dean just told a Los Angeles audience today: Bush is the first president ever willing to admit to an impeachable offense.
Noah, what if this fiasco is actually political and this technical material is simply trumped up stuff found in many security magazines?
That the NYT sat on this for a year tells me that this mess is likely known to John Ashcroft, and is also quite likely to be political rather than anti-terrorist. I we find this madness is political, Noah, we have Watergate, all over again.
The technology angle is interesting speculation but it is more likely they went around (a pretty liberal) FISA is because they knew they couldn’t get warrants for all those they really want to spy on…not just terrorists but political enemies. Don’t forget John Bolton’s hi-jinks.
Could the NSA have a working quantum computer?
Seems that anybody in the government will act rationally to ensure their survival. But nothing we are seeing is rational. Congress apparently didn’t receive adequate explanation; there would have been no downside to discussing this with Congress. The administration ignored the opportunity to get permission from the court after the fact; even the most extreme CYA mode would demand this. I can’t see that the introduction of a new technology would have any impact on either of these scenarios. As suggested above, it has to be political, perhaps eavesdropping on political opponents.
It is vital that everything in Congress’ and the court’s power to prove to the American people that Bush was not abusing power in this way.
If the abuse were political might also explain why some at NSA wouldn’t take part.
How about this: Under FISA, the only officials who can certify an application are those whose positions are confirmed by the Senate. That rules out Condi as NSA and Cheney. If the requests came out of either of their offices they would have had to go through another agency (eg CIA, State, etc..)on their way up to the Attorney General.
Maybe they were worried about Powell and others finding out. Hence the fast-track.
I had a paranoid roommate back in the early ’90s who was obsessed with the NSA. He had me read a book on the agency — it was full of speculation, crazy stuff, I thought.
One thing it mentioned was the possibility that the NSA could be constantly searching for key phrases spoken over the telephone lines. Like googling “big breasted grannies,” the NSA could pick out those speaking on “blowing up the Brooklyn Bridge” or whatever.
I thought that was impossible, even with the supercomputers the book claimed the NSA had.
But now, with speech recognition… could it be possible? That Bush had the NSA do a bulk monitoring of phone lines, its computers fishing for terroristic phrases? If that were the case, then it would be impossible to get warrants for what could be hundreds of thousands of phone lines.
Eschelon is what you’re all looking for. But don’t look to closely!!
I bet part of this story will be that the actual wiretapping and monitoring was “outsourced” to a private company. What are the legal questions that arise from non-deputized personnel doing this on the president’s behalf?
Of course ECHELON has had some sort of keyword capability for years — decades, purportedly. It was never able to routinely, transparently translate, though. We all know that phone calls about 9/11 sat untranslated until ~December of that year.
Perhaps there is a combination of voice recognition and translation going on here? Voice, translation, and decryption? That would be insane to do on an ECHELON scale, but not for 5000 specific people. Maybe ECHELON can now pick people out of the crowd by their voiceprints?
I’m just using the WAG method here, but these seem like plausible, useful developments that could justify the facts stated in the post.
So would being able to isolate 5000 targets from transatlantic traffic be sufficiently “technical” to hide from the opposition, while being sufficiently close to what was already being done that they decided they didn’t need to go through FISA?

It could also have nothing to do with the wire tapping itself. It could be the method used to decide who they wanted to wiretap. They might have broken the law on that step and that made it so they couldn’t get the wiretaps at the next step.
Maybe it’s the idea mentioned above that they monitor every call and using voice recognition only start listening in on specific calls. If a computer listens in on .001 seconds of your phone call to see if you match a voice test did they just wiretap you or does it only count if they listen to at least 1 word?
Maybe he just did it because God told him to. The guy is certifiable you know.
I doubt very much this is about technology. This is about ensuring Bush (or whoever runs Bush) has unfettered power. Presumably if we knew the targets we might know something more. It will probably turn out to be some kind of enemy of the imperium. Ultimately it is about trashing any limitations implicit in the rule of law. They want to be God.

The law says they can surveil anyone they have reason to beleive the surveilance "May provide or has provided evidence of (insert any crime here)".
The thing that scares me is the clause "Or has provided". I think it means they already spy on us but they cant officially recognize it/use it against us without a judge's approval.
This affirms it "Whenever any wire or oral communication has been intercepted, no
part of the contents of such communication and no evidence derived
therefrom may be received in evidence in any trial, hearing, or
other proceeding in or before any court, grand jury, department,
officer, agency, regulatory body, legislative committee, or other

They are saying they already intercept every type of communication imaginable but they wont acknowledge it officially without a judge's approval. As in they wont use it against you.
If that isnt a breach of privacy I dont know what would be. Maybe spy cameras in your bathroom, and that wouldnt surprise me either.
The MSNBC article that was posted for about 15 minutes didnt say it was "international" spying, it said "domestic spying on us citizens". It may have been edited for a reason as to not tip off potential "domestic terrorists", that may be what Bush is crying about.
This country is no better then China. Im sure each and every one of us is profiled by the FBI for everything we do electronically, and Im sure for alot of things we do in real life too, like having conversations in public etc that are probably eavesdropped on. I read alot of things for everything from explosives to foreign websites that dont really praise the US. I would hate to have my privacy infringed for the sole fact of some website I goto, even though my intent may be just curiosity.
And now especially that somehow we have arms control in the US, it scares me even more because we are VERY close to enslavement and not being able to stop something happening that is unreasonable. And really it is asking alot to put my trust in "humanity", too much in my opinion. I’m with Dan Hartung. Given what we know, this has something to do with the sheer volume of requests. Now, obviously, the volume MAY mean that they just couldn’t prove probable cause or anything close. But I think it may be technical, a way of scanning much larger numbers in one request.
Hey, let’s not jump to conclusions. My initial reading of the FISA statute suggests that these because these wiretaps are of individuals not associated with foreign governments, they may not have been ELIGIBLE for warrents. They may have been COMPLETELY PROHIBITED by law!

This NY times article was timed closely with the release of a book called "State of War-the secret history of the CIA and Bush administration" (anti-bush book obviously) The NYT piece was written by the same author of the book…a man named James Risen.

Considering that this happened in the aftermath of 9/11 I doubt any judge would have given the administration a hard time regarding warrants. Specially if they involved arabs or others with clear connections to islamic groups, etc.
Because I am a paranoid conspiracy theorist I would like to note that this and the expansion of presidential powers was listed as one of the goals of PNAC. If you search any of the hundreds of PNAC watchdog sites you can find the statments these members arrogantly gave about how this was something they thought was needed to combat domestic crime. Cheney and Kristol spoke of such events where the presence of the internet was making things difficult. It was giving criminals and terrorists advantages they never had before and law enforcement had to be expanded to match it.
So I think it would be wise for us to consider that the president wasn’t smart enough to make this decision on his own. Someone in the administration suggested it. Someone who had already spent a great deal of time having it researched and FISA scrutinized line by line to find it’s loopholes. If you look harder I think we will find that Cheney and those with connections ot PNAC and it’s supporters are behind this. Because clearly Bush simply isn’t smart enough to come up with this. All he did was sign off on it.

I’m still fascinated by this question. I really think it’s one of the more interesting parts of all this — the who, what, where, when, and why. Americablog is speculating that journalists were the targets, which is one of several possibilities. I’m still on this tech question, because the administration is obviously hopping mad about the how being possibly disclosed. My overnight thought was that it may have something to do with internet communications, or perhaps satellite phones. The fact that Bush mentioned in his Mon presser that Osama was using a particular type of satphone, and then stopped after the media disclosed that methodology, may mean that isn’t the actual tech in question, or it may mean that it is.
So part of all this furious hand-waving is as lady lame suggests a kind of warding off, but I think it may well be for technical rather than target reasons.

The list changes as some names are added and others dropped, so the number monitored in this country may have reached into the thousands over the past three years, several officials said. Overseas, about 5,000 to 7,000 people suspected of terrorist ties are monitored at one time, according to those officials.”
Key phrase – IMHO – “at any given time”.
Bush in his press conference said:
“We looked at the possible scenarios. And the people responsible for helping us protect and defend came forth with the current program, because it enables us to move faster and quicker, and that’s important. We’ve got to be fast on our feet, quick to detect and prevent.”
“We use FISA still. You’re referring to the FISA accord in your question. Of course we use FISAs.”
“But FISAs is for long-term monitoring. What is needed in order to protect the American people is the ability to move quickly to detect.”

Now we know he could have gotten FISA approval for any known terrorists, and could have even begun the wiretaps and gotten permission later.
So the “ability to move quickly” doesn’t make sense if we are talking about normal wiretaps.
But what if “at any given time” means seconds or microseconds or nanoseconds?
And what if “terrorist” and “terrorism” have the same meaning as in the USA PATRIOT act – including “domestic terrorism”:
…domestic terrorism means activities that (A) involve acts dangerous to human life that are a violation of the criminal laws of the U.S. or of any state, that (B) appear to be intended (i) to intimidate or coerce a civilian population, (ii) to influence the policy of a government by intimidation or coercion, or (iii) to affect the conduct of a government by mass destruction, assassination, or kidnapping, and (C) occur primarily within the territorial jurisdiction of the U.S.

If so, this program could have been used to spy on MILLIONS, not thousands, of Americans, and the “ability to move quickly” phrase makes more sense.
Bush: “This is an enemy which is quick and it’s lethal. And sometimes we have to move very, very quickly. But if there is a need based upon evidence, we will take that evidence to a court in order to be able to monitor calls within the United States.”
So – we are talking about VERY, VERY QUICKLY, and about spying NOT based upon evidence – because if they had evidence they would take it to court.
I conclude this program is about VERY VERY QUICK spying on large groups of people… like ALL OF US.
AND – I think it is a PRIVATE company doing the spying.

You’ve probably heard about Echelon, the vast listening system run by the US, UK, Canada and Australia that scans the world’s voice traffic looking for key words and phrases.
ASIDE from using the system for industrial espionage and bypassing international and national laws to listen in on people, it is ALSO used to listen out for people like Osama bin Laden and assorted terrorists in the hope of preventing attacks.

Well, it could be tied in with John Bolton (remember that NSA intercepts came in connections with him on two occasions), or it could be what it really (and sadly, always looks like) a power grab.
But getting back to the original question …
The new technology mentioned (and I’m still not buying that there is anything new here) could be either an up-rated echelon, or perhaps an NSA version of the purported soviet’s “big ears”; e.g. some sort of voice recognition direct transcript scheme.
But that’s a really tough nut to crack … then again, the NSA buys computer facilities by the acre.

And Byron…you are deluded if you think that other presidents have authorized warrantless wiretaps. The courts, by law, have always been required for oversight. And the majority of people did NOT vote for Bush…DIEBOLD machines did.
I’d take the congresscritter’s comment about “new technology” with a big grain of salt. Most of them don’t know jack about computers, and this “new-fangled Internet thingy” is a complete mystery to them. And to some reporters, too, I’ll bet. Especially from the larger papers.

This is also why the nascent beginnings into Able Danger was quickly squashed. Able Danger was a “pilot” project for this technology and it may have worked – but letting everyone know that would have revealed it.

Those who do not work in the intelligence field have no idea how badly the US crippled its own intelligence gathering after the 1970′s. Without a complete discussion of the policies that were put in effect then, it cannot be understood how we set ourselves up for a strike like 9/11. Suffice it to say that it is obvious that some people in this country bear monitoring, and the sooner we get to it the better. There are bad guys out there. Do you want them protected until they kill you and your family? Does it really bother you that the government might listen to you talk to gramma as it searches for those bad guys?
I can not for the life of me see how this has become such a big deal. Spying during War Time is a very common thing. However, I do see why it is so big. President Bush is in office now, and that is the only reason.
Numerous past Presidents allowed this type spying for security reasons without FISA approval.
Bill Clinton allowed it to be used in several instances and no one challenged his authority to do it. So, my take on this is President Bush is beginning to look good in Iraq with the Elections,Etc., and Democratic Liberals and anti war supporters are pulling all strings to make him look bad. No wander we have lost so many Soldiers in Iraq. I guess the Democratic Liberals and anti-war people will next require a private investigation.
We can never win if even our lawmakers are too dumb to see what is happening. If a Democrat was the President, you would never hear any of this.
Whomever leaked this information to the Press should be tried for treason. It has really hurt our efforts wherever we have Troops stationed.

This flap over domestic surveil by NSA is yet another example of the Bush admin trampling on the Constitution as they lead this country down the rosy path to neofascism.
The fact that the NSA has been collecting intel on people living in the U.S. only gives credence to the fact that terrorists have infiltrated our sieve-like borders for years. As Pogo is quoted saying, “I have seen the enemy and it is US!”.

Re “spying”…I think George Bush should get a medal and we should all be happy that we have NSA on our side. I think the sniping and leaks should stop…we are at war.
I would like to say that, like it or not, this is a problem beyond Democrat/Republican/Independent. The only way to solve it is tell these politicians that party politics and position jockeying is forbidden or they will lose their precious jobs altogether. When politicians give up all of our freedoms then we won’t have a need for politicians anyway.
Our freedoms are taken too lightly by gungho blind followers of people with more scary intentions. No freedom should be freely given up.
We already have countless laws on the books to deal with bad guys of all kinds and we already have a good system in place. Trouble is the people using it not the lack of it.
We have seen too little effort to hold the good old boys of either party or the CIA/FBI responsible for their failures of 9/11 and other episodes. None seem to have the honor required for their jobs. Fighting between parties on any level including the man on the street gives in to the divide and conquer tactics being used by terrorists and politicians alike.
Further, I am not a hate monger but I apologize to no one for being an American. I apolgize to no one for being non Muslim and if Muslims really want to live in peace then please turn in or take out your terrorists.
You all talk about monitoring those that kill, those that criple the US, those that do damage and break the law. YOu support the monitoring of everyone, innocent and guilty. Well have you ever stopped to think about what they are doing to prevent small criminal acts? For instance, a group of people talk on the phone every day for a week planning a bank robbery where they can get away with a few million. Does the NSA do anything to prevent this…..NO! What do the bank robbers do with the money they steal? Do they use it to fund terrorists? Feed their families? Or just have it to feel rich? What about the gang members that call each other to say where the next drive-by is? Are they stopped…..NO!
When you talk about everyone being monitored to stop those that will bring harm to the US and the people who live here, stop and think to yourself, “Are we being fully protected by having everyone monitored?” The answer to that question is obviously, “NO we are not.” Because if we were being fully protected against those that are terrorists, and terrorists in the Oath that you take when you join the military states, “both foreign AND DOMESTIC”, then we would have far lower crime rates than what we have now.
We lose more people here in the US to everyday killings that we fail to consider. We have lost more people this year to car accidents and gang-related killings than we have in Iraq and Desert Storm COMBINED!
When I took the military oath, I swore to uphold the constitution and defend our country and beliefs from terrorists both foreign and domestic. So obviously my look on this subject may be biased. BUT I do bring to light some good facts.
So I ask you, “Is the monitoring of everyone really helping to protect this country from both foreign and domestic terrorism?”
In the future I would hope all media remembers the WWII slogan “Loose Lips Sink Ships” and check with the NSA or the White House before blowing the cover on an operation. That includes this medium!
The problem with spying internally is multifold.
The door is open to limit freedom of communications through intimidation and tracking.
The machine now does some of the evaluation.
The software is never going to be correct in its assessment because the biases applied are sometimes inherent in the algorithms, buried in the order of evaluation, the datasources, the bias to the information chosen vs the data ignored, and based upon a spider like process of relationships that are beyond comprehension to a single individual.
The power of such technology is not fully understood even by those implementing the software, and the few who do understand it are considered the “lunatic fringe nerds” and no one listens or trusts what they say.
Finally, the liberty that we have in the US is wonderful, and most people want the opportunity and ability to live in such a free society. However, not everyone wants the responsibility of following laws, of honoring their neighbor, of taking a risk when things are less than ideal, or taking a risk to get ahead.
Fewer still want to lead in that process, and our media has done a good job of demonizing any leadership that is counter to their “feel good” policies, even when those policies are dangerous to our freedom. Those who want absolute freedom over their communications using the first amendment, stand hardest on removing that same freedom from everyone else. That cannot work. If no one can communicate freely with them, then their first ammendment rights are gone.
I absolutely believe that we have terrorists among us. I also absolutely believe that tracking them via these intrusive methods in our own country is counter to our best interest. I also believe that not tracking them in this way carries some risk. People will die, and perhaps I will be one of them, should these means not be used.
However, the terrorist threat is not new, and it will never go away. China built the great walls to prevent their terrors thousands of years ago. It didn’t work. We are building the same kinds of walls, just new means, and they won’t work either.
To stop terrorists, you must remove the top tier that is advocating the terrorism, but not participating. We don’t need a new technology to do that. Just some humint inside the organizations, and we even know in many cases who these leaders are, who they are speaking to, and why those people are doing the acts.
Using the terrorism to spy on our own citizens is a smoke screen, but I don’t yet know why it is being put up. Only the higher ups in our “two party system” really know that. And you can bet they are not talking.

I am confused with tyhe problem of spying in the US. The reason that the attacks on 9/11 tok place was because we had “softened” our tactics against terror suspects. We need to take a hard-line approach to the new threats. In my opinion, the only ones who suffer are terrorists. I’m sure that I’m naive to everything that takes place, but, if you have nothing to hide; why are you worried?
It is a simple question. Was the law, violated? Yes it was. Our Constitution, which everyone, including the President swore to protect and defend against all aggressors, was violated. Did he have cause? Probably. However, he could have followed the law without endangering any of his goals. He simply chose to ignore it. Unless he was given bad counsel from his subordinates. I’m sure we are all familiar with bad Intelligence being worse than none. I’ve worked with Officer’s I’ve considered exemplary. Specifically, General Michael Dugan. But without a good second in command to keep him from making bad political decisions, stating “If I want to hurt you, it would be at home, not out in the woods some place.” That’s what happens. At any rate, the violations, occurred if/when americans were surveilled by the NSA, It’s not allowed anywhere in the law, and by the failure to notify said americans when they were surveilled. The fines that can be imposed could be impressive. Especially the jail time. However, if they paid close attention, doubtful, they would have destroyed the files in accordance with the law and denied any americans were ever surveilled. God Bless America and Those Who Serve!
